Zango's Forum-Shopping Lawsuit Against Epic Cash Dismissed
A Federal court in Seattle, Washington has dismissed Zango Inc.’s reactive declaratory relief action against Epic Cash LLC (view the order here). The lawsuit was a thinly-veiled attempt to preempt Epic Cash’s suit against Zango and the entities behind AdultFriendFinder.com now pending in California state court.
Epic Cash’s attorney, Gary Jay Kaufman, Lead Trial Counsel at The Kaufman Law Group, was extremely pleased with the outcome: “The District Court saw this case for what it was, a blatant attempt to gain a hometown advantage. Zango deliberately concealed this action and then used it as an “ace in the hole” to preempt Epic Cash’s California claims and keep the litigation in its backyard. Epic Cash can now move forward with its suit against Zango and Adult Friend Finder in the proper forum.”
Associate Trial Counsel Colin Hardacre, has this to say: “Zango’s lawsuit was nothing more than home-court litigation tactics - almost sham pleading. The District Court absolutely agreed. This was a big win for Epic Cash.”
